Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Akked platform provided by Qonfirm ("Company", "we", "us"). By creating an account or using the Service, you agree to these Terms.
1. The Service
Akked automates WhatsApp order confirmation messages on behalf of e-commerce merchants. The Service connects to your store via webhooks, generates confirmation messages, and sends them through a WhatsApp account you provide.
The Service uses an open-source WhatsApp web client (Baileys) on a personal phone number you own. By using the Service you acknowledge the risks described in our WhatsApp Disclaimer.
2. Account Registration
You must provide accurate, current, and complete information when registering. You are responsible for maintaining the confidentiality of your API keys and login credentials. You must notify us immediately of any unauthorized use at security@akked.app.
Accounts are for individual businesses. You may not resell access to the Service unless you have a signed white-label agreement with us.
3. Credits & Billing
The Service operates on a credit system. Each WhatsApp message sent consumes one credit. Plan credits are allocated at the start of each billing cycle and do not roll over unless stated otherwise.
Subscriptions renew automatically unless cancelled before the renewal date. PAYG credits are non-expiring and non-refundable once consumed.
We reserve the right to adjust pricing with 30 days' notice. You will be notified via email and an in-dashboard banner.
4. Acceptable Use
You agree not to use the Service to:
- Send spam, unsolicited messages, or bulk marketing broadcasts.
- Harass, threaten, or deceive recipients.
- Violate any applicable law, including consumer protection and anti-spam laws.
- Impersonate another business or individual.
- Attempt to reverse-engineer, circumvent rate limits, or abuse the infrastructure in a way that degrades service for other users.
Violation of these rules may result in immediate account suspension without refund.
5. WhatsApp Compliance
You are solely responsible for compliance with Meta's WhatsApp policies when using the Service. By connecting a number you acknowledge the risks described in our WhatsApp Disclaimer. We are not liable for any account bans or restrictions imposed by Meta.
6. Data & Privacy
Our collection and use of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
7. Uptime & Service Levels
We target 99.5% monthly uptime for the core message-delivery pipeline. Planned maintenance will be announced at least 24 hours in advance. Credits are not refunded for outages under 1 hour in duration.
The unofficial tier (Baileys) depends on WhatsApp's web protocol, which can change without notice. We cannot guarantee uninterrupted service for that tier.
8. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, loss of data, or loss of goodwill, arising out of or in connection with the Service.
Our total aggregate liability for any claim shall not exceed the amount you paid us in the 3 months preceding the event giving rise to the claim.
9. Termination
You may cancel your account at any time from the dashboard. We may terminate or suspend your account for violation of these Terms, non-payment, or if required by law. Upon termination, your data will be retained for 30 days for recovery, then permanently deleted.
10. Governing Law
These Terms are governed by the laws of Egypt. Disputes shall be resolved by the competent courts of Cairo, Egypt. If you are using the Service from the EU, mandatory consumer protection laws of your country of residence may also apply.
11. Changes to These Terms
We may update these Terms at any time. Material changes will be communicated via email at least 14 days before they take effect. Continued use of the Service constitutes acceptance of the updated Terms.
